Truck Driver Standard of Care Expert Witness:
"AMSA Requests Exemption to the 14 Hour Rule"

The American Moving & Storage Association (AMSA), based in Alexandria Virginia has applied for an Hours of Service exemption.  The request from the AMSA is that movers be exempt from federal regulations preventing motor carriers from driving following the 14th hour after coming on duty.

According to their website, “The American Moving & Storage Association (AMSA), a nonprofit trade group, is the only national association for the full-service, professional moving and storage industry. We represent more than 4,000 companies across the United States and internationally, including suppliers and affiliates. Our members include interstate, local and international moving and storage companies and state moving associations.”

 

The special exemption would allow drivers to relocate their rigs from the residential area where they are picking up or dropping off furniture to the nearest place offering safety and security for overnight parking. This would only apply after using their maximum 14-hour work day to deliver household goods shipments.

 

According to the Federal Register the request includes a limit: “In no case would the drivers be permitted to drive more than 75 miles or 90 minutes after the 14th hour.” 

 

The Federal Motor Carrier Safety Administration (FMCSA) has requested public comment through Oct. 9 on AMSA’s application for the exemption.
